    Default ‘No talks if Pakistan insists Kashmir is a territorial dispute’

    NEW DELHI: India on Thursday said it would not discuss the Kashmir dispute with Pakistan until Pakistan stopped insisting that it was a territorial dispute.

    “It is possible to discuss the dispute once it becomes clear that Pakistan is no more insisting on dividing or exchanging the territory, or talking about settling the status of the territory,” Indian Foreign Secretary Shiv Shankar Menon said He called for adopting ‘creative approaches’ to settle issues with China and Pakistan.

    Thats true though are these just ways of showing that we are on top and in controll of these things by the government or can this be taken seriously?

    All issues, whether IPL cricket, IPI gas pipeline or Kashmir will be on hold till they are over and new gov't sworn in....so don't believe anything till then...as Aamir guessed, all political parties only have one thing in mind:votes..

    However, note the wording: GoI is not against making borders "irrelevant", statement indicates GoI wants to maintain sanctity of existing border/LoC. Back-channel non-paper was a roadmap for not changing existing border/LoC, but enabling free movement of people across the border in Kashmir, and unified governance by a common Kashmir Assembly, AFAIK. The Foreign Sec is merely stating the same position, nothing has changed.

    India has always been clear and consistant in its approach to Kashmir. No government , from Congress to BJP to Left Front have ever had any policy that is unclear. Namely, Kashmir is an integral part of India and the separatist movement is a law and order problem that has to be solved under the ambit of the Indian constitution.

    Pakistan , now is more desperate than anything else to force the Kashmiri issue on the internation stage. The status quo has not changed in 60 years and I suspect will not change in the next 60.

    Except for when INDIA approached, the UN, and when INDIA signed the UN resolutions thereby terming Kashmir a disputed territory FIRST.

    Thereby Kashmir is a disputed territory for the entire WORLD, not just Pakistan.

    No, India approached UN in August 1948. A non binding agreement was made to resolve the solution by invoking a plebscite in the disputed area
    In January 1949, UN enforced a ceasefire across the Line of Actual control.
    In 1956 , this region was fully integrated into India via Article 370 of the Indian consitution , making null and void any non binding resolution.
    Azad Jammu and Kashmir had its own legislature in 1971 and is a self governing state under Pakistan control.

    Therefore apart from from a non binding agreement, there is no legal basis for J&K to be independant. The whole of the territory is still disputed with India's claim that the Northern areas are legally and under article 370, an integral part of India.

    Well I think, whether the issue has cropped during the election time, or otherwise is the leat you should be bothered about. No land sharing deal would ever happen.

    Dont cite me UN resolutions. They were never binding on India. Kofi Annan has reiterated that again and again. Depends on whether you want to pay heed to what UN has to say or just memorize a 60 year old resolution and keep saying it again and again, hoping it would come true.
