Chinese fisherman jailed for South Korea stabbing

A Chinese fisherman has been sentenced to 30 years in jail for stabbing a South Korean coast guard to death in December 2011.
Cheng Dawei was also fined 20 million won ($17,540, £10,950) by a court in Incheon, South Korea.

The 43-year-old captain killed the officer and injured another after his boat was stopped in the Yellow Sea for illegal fishing.

The problem was pre-meditation. The prosecutor argued a pre-meditation for murder and asked for death penalty, the judges didn't buy it and sentenced 30 years under a 2nd degree murder conviction.

This won't be the end of story as both the prosecutor and the Chinese captain will appeal. Under the Korean system, all defendants of serious crime have a right to three trials. But unlike other country's legal system, the prosecutor also has the right to seek three trials even if the defendant is found not guilty in prior trials.

Only the 1st degree murder carries death penalty(Not carried out. The method of death is natural aging), so the prosecution's job is to prove the premeditation in the appeal trials.

At least Korea persecutes Chinese fishermen within its EEZ, whereas Chinese coastguard does after other country's fishermen in foreign water.

China already finished business with Korea by agreeing to send two Chinese coastguard officers per Korean coastguard vessel on fishing patrol. The Chinese officers's role is to warn Chinese fishermen to not resist the arrest by threatening a prosecution back in China if they violently resist.
