Pakistanis are getting ahead of themselves if they think the ICJ has any more power than the UN.

Military Courts are used for spies not under diplomatic cover across the world. Since they allow for complete blackout of everything. India is claiming customs that preceded the ICJ need to be changed.

Had KJ been an Indian consular/ embassy worker he'd have been released in a matter of hours/days.

Pakistan never said ICJ has more power than UN or something. Since india approached ICJ we are trying to respond on that front. KBY fate was sealed the day his sentenced was announced by military courts.
 
The Supreme Court of India is perhaps the biggest kangaroo court of the region.

It didn't even follow set precedent in case of Afzal Guru, a Kashmiri fruit seller... and the decision of the court on which bases he was hanged is perhaps the most laughable and ironic in present times... for the "desires of public".

No counsellor or investigating team was given access to Ajmal Kasab also!

Co-accused with Guru's sentence was reduced. And the entire proceedings can be acquired by filing an RTI. Unlike in the case of Jadhav. But then, Pak has a track record of even using its judiciary to hang a Prime Minister, approve coups and releasing someone like that American Davis.

Heck you don't need an RTI. Buy Arundhati Roys book "Silence of the grasshopers". And curse your judiciary.
But then, Pak has a track record of even using its judiciary to hang a Prime Minister, approve coups and releasing someone like that American Davis.
Bhutto was hanged in a murder case.

And coups aren't done by legal procedures. Judiciary has nothing to do with coups. Seems you are ignorant to know such things. And before you criticise Pak.. take a look at several cases not just Afzal Gurus.

And do tell us what you know about Islamic Jurisprudence?

1. It is a matter of record that Shaukat Guru's and SAR Geelani's death sentences were commuted by the very Supreme Court in the same case where Afzal Guru's death sentence was upheld.

2. Your Supreme Court validated the coup of Pervez Musharraf.

3. Pakistan refused consular access to Kasab.

All these are matters on the record. To quote a semi-literate person - "Mere barking without knowing any facts doesn't mean what you bark will turn into truth."

ICJ verdict on jurisdiction in Atlantique case today


THE HAGUE, JUNE 20. The International Court of Justice (ICJ) will deliver its judgment here tomorrow on whether it had the jurisdiction to adjudicate the dispute raised by Pakistan with India over the shooting down of the former's naval aircraft in the Kutch region last August.

The verdict of the 15-judge Bench will be pronounced by the court's president, Mr. Gilbert Guillaume, of France at a public sitting in the Great Hall of Justice of the `peace palace'.

The verdict is final without appeal and should one of the parties fail to comply with it, the other can have recourse to the United Nations Security Council, according to the court procedures. The court is the U.N.'s principal judicial organ.

Pakistan wants the court to intervene while India is opposed to its assumption of jurisdiction on the basis of Islamabad's application.

Pakistan has urged the court to ``dismiss the objections raised by India and accept its jurisdiction''. India maintains that none of Pakistan's arguments is `sound' and does not provide a basis for invoking the court's jurisdiction.

Public hearings in the case titled `aerial incident of August 10, 1999 (Pakistan vs India)' lasted four days ending April 6 last. These centred on the court's jurisdiction, which must be determined before the case's merits can be considered by the 15 judges.

Pakistan has accused India of shooting down the `unarmed' Atlantique aircraft killing all the 16 naval personnel on board and is seeking about $ 60 millions in reparations from India and compensation for the victims' families.

India argued that the court does not have jurisdiction, citing an exemption it filed in 1974 to exclude disputes between India and other Commonwealth States, and disputes covered by multi-lateral treaties.

This merely highlights that the trial was a sham trial in a kangaroo court - the decision was known to the Government before the military court passed its judgment? Indians don't realistically expect to get Jadhav but it would be handy to expose the Pakistani system.
This not Indian courts we are talking who need at least 30 years per case to solve. We are far advance then your Kangaroo courts.
