SC to examine Bengali Assam migrants’ plea

Terming as “extraordinary” the situation of Bengali-Hindu migrants in Assam, the Supreme Court on Friday agreed to examine a plea to grant refugee status to them.

“We are not underestimating your concerns, considering the current situation in the state... we understand it is not an ordinary issue,” said a Bench of Justices P Sathasivam and Ranjan Gogoi.

M N Krishnamani and Pinky Anand, counsel for the petitioner, NGOs Swajan and Bimolangshu Roy Foundation, told the court that more than two lakh immigrants in Assam have been denied benefit of the proviso to Section 2 of the Immigrants (Expulsion from Assam) Act, 1950, which bars Foreigners’ Tribunal from deporting from Assam persons “who on account of civil disturbances or fear of such disturbances in area forming part of Pakistan has been displaced from and has left his place of residence in such area and who has been subsequently residing in Assam”.

“Moreover, it is not a problem afflicting only Assam. Some other eastern and north-eastern states are also affected by this,” the counsel added.

The Bench said the petitioner should also implead these states and come back to the court for redressal after two weeks.

The court had initially asked the petitioner’s counsel to approach the High Court for a “more effective consideration” but they argued that citing a recent High Court order, the authorities were pushing out most of the migrants without granting them the benefit of the proviso.

“The present dispensation in the state has resorted to targeting both genuine citizens and also the ‘displaced persons’ belonging to the Bengali-Hindu community in Assam. These persons... are being apprehended and pushed back to no-man’s land along the Indo-Bangladesh border and left to die there,” the petition said.

BENGLAI MUSLIM ARE ILLIGAL IMMIGRANTS BY THE WAY BIG RIOTS IS NEAR IN NEXT 1-2 YEARS .THIS TIME THEY SEND EVERY ILLIGAL BANGLADESHI TO THEIR ANCCENTOR HOMELAND LIKE ROHINGYA.
 
So Bengali Hindus are to get preferential treatment. Bengali Muslims on the other hand ........
Coming from a resident of a country where 32% of Hindus have been cleansed to 7%. And you call Bengali Hindus to get preferential status?

Why people on this forum, look the things from neutral angle leaving religion aside, and understand the condition of many Hindus considering humanity just for once.

I would really like to know what you people think, most of them consider themselves as the beacon of right and justice on this forum.
 
Bengali Muslims are not being kicked out, hence they have not approached the supreme court.
Another kashmir in the making where the local pundits where forced out of their homes.

Its funny, when Hindus are killed and displaced in thousands of number in India, no one cries foul play but if even one Muslim is killed in India, entire region start to show us human rights.
 
Even if they are getting preferential treatment, that is two nation theory for you.
 
Good one. Atleast Indian SC has moral fiber. And I would be twice happy if SC comes with a favourable decision in that it goes with my line of thought.

These are people who displaced during partition as they are seeking benefit of immigration act of 1951. How do they compare against the recent Bangladeshi Muslim immigrants as Bangladeshi Muslims aren't fleeing religious persecution and neither lost their property but merely economic scavengers.

That's because we know that illegal Bangali hindu immigrants won't be taken back into their country Bangladesh.....and we being the only major hindu majority country we have some responsibility toward them......that we have to fullfil

Don't fall into Munshi's trap, they are not getting any preferential treatment but only taking refuge to existing legal framework of India which has provision for those who displaced during partition or facing religious persecution and fleeing from areas which were formerly Pakistan.
