President excuses punishments of Mr Rehman Malik

Express news has broken the news that Mr Asif Zardari has excused punishment of Mr Rehman Mali Interior Minister. These punishments were revoked by Lahore High Court:hitwall::hitwall:

rehman is the one gaurding his seat, zardari would do anything to protect his last tenure!!!!

ISLAMABAD: President Asif Ali Zardari Monday condoned the sentence of Rehman Malik hours after the Lahore High Court dismissed the latter’s pleas, according to the presidential spokesman.

Rehman Malik’s sentence stood restored following the rejection of his review petitions by the LHC earlier today.

According to legal experts, Rehman Malik could be arrested any time following today’s decision of the court.

Musharraf interfered in Aziz-Chief Justice tussle and ultimately had to lose all his powers and leave the politics shamefully. I wonder if Zardari too going to regret in a similar fashion after pardoning Rehman Malik and going for another war with the Judiciary?

I hope not another drama starts and we further destroy the image of our country.
 
Musharraf pardoned Wasim Sajjad's sentence. Presidential Pardons are granted to advisors and close associates throughout the world. Nothing new or weird going on here.

Article 45. President's power to grant pardon :- The President shall have power to grant pardon, reprieve and respite, and to remit, suspend or commute any sentence passed by any court, tribunal or other authority.

Anyways, I've always been amazed by the hatred of the public towards Rehman Malik. Hatred towards Babar Awan is justified for he has constantly been creating problems b/w the judiciary and the executive; but I'm flabbergasted at the hatred towards Rehman Malik for nobody has a valid reason for it. Claiming that "he hasn't stopped suicide bombings" is idiotic. His political association with Zardari camp and the initial attempts at transferring ISI from MoD to MoI have made the military and the establishment hate him. The public's hate towards Malik is just the way of the public showing their dislike of the current setup and not based on incompetence.

President pardons Malik in all NAB references

LAHORE: President Asif Ali Zardari has pardoned sentences awarded to Federal Interior Minister Rehman Malik in all National Accountability Bureau (NAB) references.

The interior minister had appealed to the Lahore High Court to acquit him in the NAB references but the court upheld the sentences awarded to him. The President has the power under Article 45 of the Constitution to remit sentences announced by the courts. Earlier, a special division bench of the Lahore High Court (LHC) on Monday dismissed Malik’s appeals against his conviction in two references by the Rawalpindi accountability court. The accountability court had sentenced Malik to three-year imprisonment each in two corruption cases filed by NAB.

According to legal experts, Malik’s conviction by the accountability court stood restored after the LHC verdict while a suspension of his punishment granted by the LHC also stood overturned. LHC Chief Justice Khawaja Muhammad Sharif and Justice Waqar Hasan Mir handed down the judgment which they had reserved on May 6 after hearing arguments of Malik’s counsel. The references were filed against Malik in 1997 and 1998 on the basis of cases registered by the Federal Investigation Agency (FIA) against him.

In the first reference, Rehman Malik was accused of receiving two cars worth Rs17,98,000 from Saleem Godial of the Toyota Central Motors, Karachi, as illegal gratification on account of purchasing official vehicles by the FIA worth millions of rupees from Toyota Motors. The second case against Malik was registered by the FIA on the complaint of Hashim Raza, a resident of Lahore. Raza alleged that Malik, along with assistant director FIA Islamabad Muhammad Sajjad Haider, raided his house in August 1994 and looted jewellery weighing 20 tolas and Rs7,00,000 in cash. The complainant further alleged that the two officials snatched $20,000 from Raza’s brother.

Both cases were initially heard by a special court dealing with the FIA cases but were transferred to the accountability court after the promulgation of a NAB ordinance in 1999. Under the National Reconciliation Ordinance (NRO) the proceedings in these references were stopped. However, the cases were reopened after the Supreme Court nullified the NRO. Malik’s counsel Chaudhry Mushtaq in his arguments had said that the Supreme Court set aside conviction in absentia under section 31-A of the NAB Ordinance in numerous cases as it was against the principles of natural justice.

He said cases against Malik were fabricated on political grounds as no evidence was ever found against him. NAB prosecutor, however, defended the conviction and cited the Supreme Court’s decisions to substantiate his arguments. On Jan 7, 2004, Malik was sentenced to prison for three years in absentia under section 31-A of the NAB Ordinance, 1999. On March 5, 2008, the court terminated his sentences/ convictions in both the references under the NRO. On December 22, 2009 a division bench of the Lahore High Court suspended his three-year sentence and granted him bail. Before announcing the decision on Monday, the LHC had accepted Malik’s application for exemption from personally appearing before the court saying that he was abroad on an official tour and could not appear before the court.

Meanwhile, the interior minister met President Asif Zardari at the Bilawal House after the LHC ruling. Officials said matters relating to the verdict came under discussion. Malik is understood to have decided to challenge the LHC judgment in the Supreme Court. His lawyer may be filing a petition anytime soon. Rehman Malik is hatred/disliked due to various reasons.

1) You may not believe but the first reason that comes in my mind is the name "Rehman" - Which is not allowed/disliked in Islam as per some Muslims's belief. (According to them It should be AbdurRehman and Rehman is dedicated to God only).

2) He is the beneficiary of NRO - and it is a common belief in Pakistan (espacially in Punjab) that the beneficiaries of NRO are corrupt peoples and on top of that he was appointed by the recommendations of Asif Ali Zardari (the most disliked politician in the history of Pakistan).

3) He was the Chief security incharge when Benazir bhutto was assasinated and is widely cursed among Benazir's supporters for poor security arrangements.

4) He was strictly against PML-N and we all know peoples in Pakistan support political families blindly (Nawaz Sharif family, Bhutto family, Wali Khan Family) so the supporters of PML-N cannot like him whatsoever.

5) Analysists such as Zaid Hamid does not like him so his followers will have to follow his footsteps :lol:

His name is Abdul Rehman Malik, you are wrong on this account. Like many people, his name is commonly used without the Abdul/Abdur.

But he is commonly known as Rehman Malik only. Even on his website he prefered to write A Rehman Malik instead of Full Name. Like me the common man of Pakistan does not know his full name and this will continue spoiling his reputation in public.

Who said anything about the Establishment punishing him? I was merely referring to public hatred towards Rehman Malik. As he is a prominent, proactive face of the government, he is ridiculed and criticized more often than other sleeping members indulging in widespread corruption. That is, I was expressing my views over public hatred towards Rehman Malik and the reasons behind it which to me are unfounded mostly.
 
I believe it is Sindh High court that has allowed the president to pardon him. Recently I heard through reliable sources that Mr. Babar Awan who believes that Pakistani parliament may even look into the idea of having a ten year un-removable tenure he related it to how Musharraf and Zia both got ten years too so why not a democratic government?
