Three Chinese engineers arrested in India



I fear, they might get executed.

This time the CPC should learn a lesson and come out of the delusional Sino Indian friendship. China should arrest all the indians in China in retaliation.

So the police arrested three engineers who happen to be Chinese in accordance with their investigation into an accident that killed 50 people and according to you China should arrest innocent Indians in China in retaliation? The arrest of 3 people means more than the deaths of 50 people does it?

By the way, most of the dead were workers, you know the subalterns that Communism is supposed to defend? Some Communist you are :rolleyes:

One more thing, all people from the company were detained. Not just Chinese.

Those women were most likely drug traffickers who could potentially kill tens of thousands of people. They could also be human traffickers who vend babies/children, even send the innocent children to prostitution...

I think I should belive the trues, and I belive Indian people know their own thing more than the others.
But there are some Chinese people involved, and the consistent hostility from the Indian society. I hope Indian judicial system deal with those Chinese justly.

First thing first they will not be executed since they have arrested under such sections of Indian law that does not have provision for death sentence.

Second, they have arrested after proper investigation. There are many contractors who come just to make fast bucks and gone.

If there is a accident then someone is responsible for it, no matter it is Indian or Chinese if someone is guilty proven beyond reasonable doubts he will be punished.

Moreover, i think in this case these Chinese will be fined and deported back to China and that particular Chinese firm will be blacklisted from doing further business in India.

And it is fair for Chinese, what' say.
 
It was the bone-headed Indians who forced to "hire local companies" for the construction. Same thing with Hyundai Engineering, they partnered up with a local Indian company and tons of bridge collapses, building collapses, etc.

NGOs voice concern over workers death at CWG sites

# With the national capital furiously gearing up to meet the deadlines of the Commonwealth Games, the alarming number of deaths of construction workers in absence of proper safety norms and adequate compensation is a cause of concern, say social activists.

The actual number of accidents and casualties are much more but many such cases never get reported, they add.

Fifty nine construction workers were killed and 115 suffered serious injuries in the city during the year 2008-2009, according to Commonwealth Games Citizens for Workers, Women and Children (CWG-CWC), an independent agency, which documents fatalities amongst construction workers in the capital.

"Workers on CWG are being made to work 12 hours at stretch to meet the deadlines, which is a complete violation of the Construction workers act of 1996 which recommends a 48 hour working cycle per week," says Subhash Bhatanagar, who heads Nirman Mazdoor Panchayat Sangam (NMPS), a NGO.

"Unlike metro rail construction sites, deaths at other CWG sites are in isolated place and mostly unreported. According to our survey, most of the contractors don't follow the safety norms," he adds.


As per Building and Construction Workers Act, the employers are supposed to ensure checking and testing of equipment and machinery deployed at the sites, occupational health hazards and stress among workers at construction sites.

The activists also wonder whether the kin of deceased labourers have been compensated as per workers act. "Delhi Construction Workers Welfare Board was constituted in 2002, but none of the construction workers, not even a single one, has got any death compensation from the Rs 300 crore plus cess collected by the Board for such emergency relief because none of their workers is registered with the Board," says Bhatanagar.

Industry insiders say the normal practice in the construction industry is that after an accident all the relatives of the victims are immediately made to disappear from the accident site. Thus making it impossible to ascertain if the compensation has been paid. In these circumstances there is absolutely no question of the compensation being paid in accordance with the construction workers Act," they say.

The Delhi Human Development Report of 2006 suggested that there were around two to three lakh construction workers in Delhi but CWG-CWC estimates that there are about 8-10 lakh workers presently in the capital, largely migrants brought in from Uttar Pradesh, Bihar, Chhattisgarh and Jharkhand by contractors and sub-contractors.

"There are supposed to be safety committees with worker representation and qualified safety officers for every establishment employing 500 or more workers. But none of the provisions of the Act has ever been followed in any of the construction sites," says Kanarindhana, Research and Campaign Officer, CWG-CWC.

During 2002 to 2008, 290 deaths and 481 injuries were reported from construction sites, reveals NMPS data. According to a report by the People's Union for Democratic Rights (PUDR), an Indian civil rights group, thousands of workers are not being paid the minimum wages due to them and have been working in extremely unsafe and inhuman conditions, especially at the construction site near Yamuna river bed.

"None of the workers employed by the contractors is paid the legally stipulated minimum wages or overtime. Unskilled workers are paid Rs. 85 to 100 per day as against the stipulated minimum wages of Rs. 142 for eight hours of work. Workers are made to work all seven days a week on normal wages and are not given any leave," says Moushumi Basu, Secretary, PUDR.

The PUDR report claimed labourers had to share 10ft by10ft brick huts between six to eight people. The rooms, which have tin roofs, have no fans.

There were unreported deaths of more than 100 construction workers at the CWG Village due to outbreak of Meningitis last year due to unhygienic living conditions, says Kanarindhana. "Workers on Commonwealth Games project are being made to work 12 hours at a stretch. This is in complete violation of the Construction Workers Act of 1996 which recommends a 48-hour working cycle per week," she says.

A study by Building and Woodworkers International (BWI), a global union with members in construction industry, estimated that 300,000 workers will be needed for this level (CWG) of activity, over 3 years. Among them will be 100,000 unskilled construction workers, at least 5,000 of whom will be women, and their 10,000 migrant children. In all, 5 lakh jobs are likely to be created in Games related activities (airlines, airports,tourism, transport, etc).

"Children and families of the migrant construction workers are not at all taken care of at most of the sites. Infact having children or women deprives work availability at few sites. Medical facilities, Schooling, Maternity homes and other basic equipments are not available at most of the sites. There are one or two 'show piece sites' but generally no such facilities are available," says Bhatanagar.

The high profile Delhi Metro construction sites are also no stranger to accidents. According to Urban Development ministry report, more than 100 people, including 93 labourers, have died in accidents at sites of the Delhi Metro since October 1998 when the construction started.

The report also said that the Delhi Metro has no policy to provide employment to the dependents of the person who die in accidents at the construction sites. :police::police::police::police:

The problem is India's KANGAROO COURT SYSTEM that will use these innocent engineers as SCAPEGOATS. You understand the terminology "scapegoating" don't you?! It means the guilty blaming the innocent for their mistakes. Please see the previous articles I posted to understand this was a LOCAL INDIAN company that was SUB-CONTRACTED (which was forced upon by GOI). :hitwall:

Imagine how Indians are so racist against DIGNIFIED foreign visitors, especially Mongoloids from Japan, Korea, China/TW/HK, Viet nam, Malaysia, etc. I experienced this myself, so don't bullsh1t me! :woot:

i couldn't remember exactly, but i heard the chinese company got the case from indian gov and then passed it to an indian construction company. all the chinese company did was probably just designing the chimney. how hard can that be to design a chimney?

if the reality was like what i said, the fault that those engineers can possibly get was picking the wrong company to finish the construction.if that indian company was licensed by indian gov, who should the people blame to?

anyway, if these engineers were really responsible for that, they should pay the price, no doubt for that. now i just worried about the justice since indian got those discrmination on chinese and the stupid media will lead indians to a wrong diriction regardless of truth.

Jan. 12 (PTI): Over 20 Indians have been detained in the Shenzhen region of China for alleged diamond smuggling.

The detentions were made on Friday, and the Chinese authorities are moving to press charges of diamond smuggling against them, sources said.

The Indian embassy in Beijing has taken up the matter with the Chinese government. Indian officials have been granted access tomorrow to the 21 detained.

According to Chinese media reports, 50 people, including 33 foreigners, who were allegedly part of a smuggling ring have been arrested.

The ring procured diamonds in Hong Kong and hired Indians and local carriers to smuggle them into Shenzhen before distributing them among factories, a media report said.
 
Indian friend said they havent execution for many years. It is fortunately for those Chinese people.
I heard Indian execution is was terrible,usually they smash the prisoners to death by raging people with stone.

Read the previous article, and there's much more about the disgraceful utter lack of quality and safety norms in India. Hyundai construction and engineering was partnered up with an Indian company for bridge constructions and such, which in the last few months ALONE so many have collapsed causing fatalities. Upon more careful inspection it was DISCOVERED that the work was carried out by the LOCAL company, and this same company had such a DISMAL TRACK RECORD of FATALITIES AND ACCIDENTS! :sniper:

INDIA: No to torture, establish rule of law!

The first Prime Minister of India Mr. Jawaharlal Nehru said "Police is standing on a quadrilateral from where they can protect and also violate human rights?" But it seems that his words are of no use in India today since there is an enormous increase in the incidents of police torture during past few decades.

It is apparent that police is the largest agency constituted with the purpose of establishing the rule of law and human rights. One can read into the Indian Penal Code, with certain difficulty, the prohibition against torture. Statements recorded from witnesses under Section 161 of the Criminal Procedure Code are not blindly admissible in a criminal trial. If the law is so, the next obvious question is then why do the police resort to torture?

The main reasons are feudal and colonial structure of police, scarcity of resources in the police department, political intervention and the lack of an independent agency to investigate the crimes committed by the police themselves. Modern investigation is unheard of within the police department. In addition, India's feudal society condones the use of torture.

The definition of torture as envisaged in the UN Convention Against Torture and Other Cruel, Inhuman or Degrading Treatment or Punishment defines torture as an "act by which severe pain or suffering, whether physical or mental, is intentionally inflicted on a person for such purposes as obtaining from him or a third person information or a confession, punishing him for an act he or a third person has committed or is suspected of having committed, or intimidating or coercing him or a third person, or for any reason based on discrimination of any kind, when such pain or suffering is inflicted by or at the instigation of or with the consent or acquiescence of a public official or other person acting in an official capacity."

Section 176 (A) of Cr.P.C. have provisions for the investigation in the each case of custodial death. However, this section is not used in any case in the entire Uttar Pradesh state. Neither have any Magistrates issued search warrants under Section 97 of Cr.P.C. when persons were taken into illegal custody.

The Supreme Court of India had issued guidelines to be followed by law-enforcement officers at the time of arrest and questioning in the case D.K Basu vs. West Bengal. It is mandatory for the law-enforcement agencies to follow, but is been negated in the state. Regarding encounter killings, the National Human Rights Commission has directed the country's police to register cases in every case of reported encounter killings. The Commission has also directed to send it a video of the post-mortem examination in each case of custodial death. This also is not followed in the state and to the information of the PVCHR anywhere in the country. The question than is what is the value of the Supreme Court and the NHRC in the country?

There is a provision for interim relief to be awarded as compensation under Section 19 of Human Right Act. Article 21 of Indian Constitution guarantees the right to life with dignity, which is also against torture. But torture continues unabated in the state. Do laws in the country have any meaning then?

If we look at the statistics, it is mostly the poor, the marginalised, the Dalits and the members of the minority and backward communities are subjected to torture. Those who have mafia gangs and known antisocial elements are not victims of this, cruel practice other than some rare occasions. Only the ordinary people are afraid of the police and the torture they practice. So does India have two types of citizens -- the one with rights and those who do not have them?

Police along with the criminals have established the rule of the lords. Corruption and discrimination are no more mere practices, but the second nature of the police. Rule of law can be established without preventing police torture. Let us come together to enlighten ourselves and fight against torture to stop it and thus establish rule of law.

What you can do?

1) Protest on 26th June against the practice of torture by street plays, organising discussions and sending letters to the Prime Minister, and through press releases in newspapers condemning torture and inform us what you did;

2) Indian Government has signed the UN Convention in 1997 but has failed to ratify it. Send letters to the Prime Minister and the President of India asking them to require the government to accede the convention;

3) In protest of the cases of torture happening right under the nose of the National Human Rights Commission, organise a protest in front of the Commission;

4) Write letters to the editor of publications condemning torture;

5) To sensitize the people about torture and its forms, take down cases that you come across and send it to us so that we could follow it up on your behalf;

6) Write to the Supreme Court asking why its orders and guidelines are not followed;

7) Write to the government urging the government to provide resources to the police to function properly.

Three Chinese engineers have been arrested in connection with a building collapse last year in the Indian state of Chhattisgarh.

The engineers, who work for a Chinese firm, have been remanded in custody.

It is not yet clear what caused the accident, but officials from all companies involved have been detained.

The chimney was being built by India's privately-owned Bharat Aluminium Company at a power plant in Korba.

The company had hired the China-based Shandong Electric Power Construction Corporation to build the power plant, reports say.

The China-based company is then reported to have sub-contracted the chimney construction work to an Indian firm.

A recent report by the UN's International Labour Organisation said that nearly 50,000 Indians die from work-related accidents or illness every year.

Indian justice system is not that harsh:toast_sign: lets not flame :flame: it has nothing to do with them being Chinese or china. Its more about wrong engineering which has led to an accident.& now ppl who built it are being held responsible that's all.
