Italy lied to us: Will we hit back or stay a banana republic?

Sending them back, knowing very well they will not return and now sensational suggestions of hit back? Are you going to attack Italy?

First of all, they were send back on the personal assurance by the Italian ambassador/ Govt. of Italy to the court & If i am not wrong they were forced to pay Rs. 6 crore sum as a Guarantee.

Secondly, The issue is not that simple as some will like it to be:

1. In all likelihood, the fishermen were killed in International waters where Indian law doesn't holds, even than thanks to ICG/IN, we could brought them to India to face Indian courts.

2. They had spent complete one year under Indian custody.

3. They had even payed a compensation of Rs. 1 crore each to the fishermen's families, but to there surprise they weren't let to leave India.

These are some of the steps, that one could say were pretty bold enough, unlike cases of foreign nationals handled in the past by the GOI.

Though, now they are saying that they will not come back, i think the pressure from opposition, judiciary, media & most important people of India will be Big enough for govt. to handle, they will be forced to act on the case.

Just wait for the Diplomatic war to begin b/w the two countries.
 
Blood money is law of land, do you have it in India as well?
No they dont But then again they will Follow the lead of a Leader(pakistan) and Try to get blood money to save face from the blunder created by their supreme court thunder in saving the face and diplomatic ties :lol:

INDIA should STOP COMparing with Pakistan in this matter BLOOD MONEY IS LAW OF PAKISTAN and NOT INDIA so dont be a h1jra nation and copy other Nations but stand your Ground FACELESS india

First of all, it was the Indian Supreme Court which gave them leave, so why are people blaming Congress? Are you saying the Supreme Court is not independent?

Secondly, the issue now moves from the courts to the foreign office since it seems the Italians are claiming diplomatic immunity.

Now take one scenario:
Step 1: The Italian government has now brazenly informed us that Italian Marines won’t be returning to India.

Step 2: India responses by minimizing diplomatic relationship with Italy on this issue.

Step 3: Italy responds Indian move by not sharing information related to AgustaWestland Scam.

Final Result:
Italian marines get away and no one is caught in helicopter scam which includes Senior politicians, Bureaucrats, senior IAF officials as well as THE FAMILY.

I am just pointing out one possible case.
 
Yea but blood money payment is not a Law in India unlike pakistan where it is law if the victim family request blood money the suspect can walk free, Unlike india Where there is no such Law, so even if that happens IT WILL STILL BE A banana Republic Move, India should demand them back or send the Italian Mission back to italy and put trade sanctions of its own italy would loose all its overnight banking and all the call centers in india and wont get any cotton from india and other things which india export them

Even full might of USA's severe trade sanction can not force Iran to walk in line.

Neither India is USA nor Italy is Iran. So NO practical utility of sanctioning Italy albeit it will harm India more.

Remember India is a developing country and it has its own limitations.

Fate of whole India can not be held hostage of just 2 mariners.

Britain is paying price NOW for not helping us in 1998 international sanctions and we are buying big time from French for same reason.

India will teach a right lesson at right point of time. For now just move on guys :P

If killing happened in international water than i don't think Italy will ever return them - max you can go to ICJ, where they are likely to win, and they have already paid compensation - so, consider this file close.

Yes you are right, case is closed for India.I think releasing was intentional because there was international pressure on India as India is detaining them illegally..but our kerala government cling it on.

Regarding blood money , there is provision of out of the court settlement in India called plea bargain, or Victim family might withdraw case in lieu of handsome money or there can be many masked provisions which lawyers only knows

1 ---> Yes, it was the SC which gave the permission, but GOI was equally involved as it didn't oppose the case of them being given 4 weeks leave while the ruling was still pending in the SC. Since, GOI didn't oppose the case, there was no way SC could have changed it's decision.

2 ---> Diplomatic Immunity doesn't apply to any Tom, Dick or Harry. To be eligible for it, a person should be the state guest of another nation or should hold a Diplomatic passport, which these two marines were not.

I haven't heard any such provision in case of murder - if there is than why they were still under custody after paying handsome compensation? and why Indians make fun of blood money provision in laws of Islamic countries?
 
Italy did not lie to us... we just facilitated Marines exit. Pattern of events suggests that this was a well thought out plan... & govt in India knows very well that this hue & cry is just a passing stage. Afterall there have been such instances in the past where our government gave safe passage to international criminals... whether it's Walter Anderson in Bhopal gas tragedy or Kim Davy in Purulia arms drop. Italians have quite a few cards to play against Indian leaders, if push comes to shove. & i don't blame them for using one such this time around.
 
abdul mazar madani a Indian citizen is kept in jail in his entire life without even letting him bail for his basic necessitates like medical treatment, all this just for court trails and procedures, he is not even proven guilty. on the other hand some foreign citizen is given permission to celebrate Christimas and then to go vote.. what is wrong with our judicial system ?

Why should the GoI intervene in a decision made by the SC? If the SC was satisfied with the assurances, then what right does the GoI have to go around second guessing them?

If the GoI had intervened, people would accuse them of overstepping their bounds and messing with the Judiciary.

I don't know the details of the diplomatic immunity protocol but, from the article above, it seems the Italians are saying that the marines were representing Italy while on duty, i.e. they were state actors. Also, if they can prove that this occurred in international waters, then there's no issue of whether India granted them diplomatic visas.
