Pakistan has decided to fight "war of law" in International Court of Justice vigorously.

وزارت خارجہ نے بھارت کی جانب سے کلبھوشن کے معاملے کو عالمی عدالت انصاف میں لے جانے کے بعد اہم عالمی فورم پر بھی بھرپور قانونی جنگ لڑنے کا فیصلہ کیا ہے۔

بھارت کی جانب سے ’’را‘‘ کے ایجنٹ کلبھوشن کا معاملہ عالمی عدالت انصاف میں لے جانے کے حوالے سے وزارت خارجہ کا اجلاس ہوا جس میں موجودہ صورتحال اور تازہ پیش رفت پر غور کیا گیا، ذرائع دفتر خارجہ کے مطابق کلبھوشن معاملے پر عالمی عدالت انصاف میں مناسب قانونی جواب دیا جائے گا تاہم عالمی عدالت میں جواب کے لیے پہلے مکمل تیاری کی جائے گی۔

انٹرنیشنل کورٹ آف جسٹس نے ٹوئٹ کے ذریعے آگاہ کیا ہے کہ بھارت نے کلبھوشن یادیو کی سزا پر عملدرآمد رکوانے کے لئے اپیل کی ہے جس میں درخواست کی گئی ہے کہ کلبھوشن یادیو کی سزا پر عملدرآمد فوری طور پر رکوایا جائے اور کسی بھی تاخیر یا معاملے کی سماعت کے بغیر پاکستانی حکام کو کلبھوشن یادیو کی سزا رکوانے کا حکم جاری کیا جائے

واضح رہے کہ کلبھوشن یادیو کو گزشتہ سال بلوچستان سے گرفتار کیا گیا ہے جس کے بعد اس نے تحقیقات کے دوران پاکستان کو غیرمستحکم کرنے کا اعتراف کیا

Translation (main points)
Pakistan will fight its "war of law" about terrorist Kulbhushan Yadev in the international court of justice. It was decided in a meeting in the foreign office.

Earlier, in a tweet, ICJ had announced that India has contacted ICJ to stop execution of Indian terrorist Kulbhushan Yadev.
 
Isnt sentencing KY to death is Pakistan's internal matter? According to principle of non-interference, IJC is not allowed to interfere in the domestic affairs of a country.

I am no legal expert on that - but it would be a surprise if judges of international court are willing to consider this case. It is a matter of terrorism and if world stands with terrorists - gone is the world's peace.

And when India will be refused a case by ICJ - India will actually lose big time! Wait and see.

I dont know is it in ICJ jurisdiction to interfere in the trial of a captured 'terrorist and spy' like Kulbhushan Jadhav?

Secondly, Indians talk over consular access while its not a universal right. It is regularly not given by many countries for National Securiry reasons. So you are right. Indians are goona lose big time.

I dont think so. Was watching international news channel yesterday and noticed experts taking Indians side there about the consular access and all. There is no doubt that KJ was not getting released and there was no one to pressurise Army with in Pakistan but Nawaz must be happy now that his investments will be safe now in India as we are going to lose it one more time because of incompetent Government and FO.
 
The Chinese did not recognise international court so should we and we should straight away hang him for his role against our country





Pakistan should only show middle finger to ICJ and ask what they have done so far for the Kashmir ? and innocent people being killed ??
What they have done so far for the UN Resolutions on Kashmir ? the answer is NOTHING ..

This ICJ can be double edged sword.If Pakistan obey's ICJ order and overturns the military court decision then domestic situation will go bad and if Pakistan refused ICJ order then also problem because threats of IWT suspension by India will then drastically arise.

Pakistan has enough proofs that the Indians will be suicidal to bring this to court.
It is a win - win situation for us.
