Shariat doesn’t recognize telephonic ‘nikah’: Mufti Naeem

Updated at: 2102 PST, Friday, April 02, 2010
Shariat doesn’t recognize telephonic ‘nikah’: Mufti Naeem KARACHI: About Shoaib Malik’s alleged ‘nikah’ with India’s Ayesha Siddiqi on telephone, Mufti Muhammad Naeem says that Islamic Shariat does not recognize any such relationship, which cannot be trusted.

According to the Shariat, he said, eyewitnesses’s account is obligatory for the verification of nikah.

He said that the acceptance of both bride and groom in front of the eyewitnesses was necessary as per Shariat.

The telephonic testimony is not trustworthy according to the Shariat and neither there is any standing about the acceptance of groom.

i m not sure but i think she said that she first met him at dubai in 2000 not on internet.

BBC NEWS | South Asia | Cricket's cross-border love story

At a time when the flowers of friendship between India and Pakistan are blooming, an unusual love story involving a Pakistani cricketer and an Indian girl has caught everybody by surprise.

When Pakistan's cricket team arrives in Hyderabad next week for a practice match, it will be an extraordinary occasion for one member of the team.

This is because the bowler, Shoaib Malik, will be meeting his in-laws.

His wife is Ayesha (aka Maha Siddiqui) - a Hyderabadi girl brought up in Saudi Arabia. She is an administrator in a Jeddah school, and is currently doing an MBA course.

But the two are yet to be formally wedded as they had performed their nikah (marriage) nearly two years ago over the phone.

Accidental meeting

Ayesha told the BBC that the two had met for the first time in Dubai in 2000 where Shoaib had come as a member of a Pakistani team and she was there with her family shopping.

Ayesha recalled that they first met accidentally at a hotel where she had gone for a meal and had left behind her keys.

A young man came to return the key and he later turned out to be Shoaib.

The friendship which started with that meeting ended with nikah over the phone (which Islamic Shariah law permits) on 2 May 2002.

Families' disbelief

Ayesha said a brother of her friend was a witness from her side and Shoaib's brother-in-law and friends acted as witnesses from his side.

The nikah was performed when she was in Hyderabad and he was in his hometown Sialkot.

It was much later that Ayesha broke the news to her parents through her cousin and - after initial surprise and disbelief - the family gave the consent.

It was ditto in Sialkot and now both the families are getting ready for a formal wedding in August after Ayesha is settled down in Pakistan

This was on Sunday, 27 March, 2005.

So this again puts a question mark over the deception thingie. anyways... anyone seen MUJHSE DOSTI KAROGE.... Similar storyline...

HYDERABAD: The buzz around the wedding of tennis star Sania Mirza with Pakistani cricketer Shoaib Malik was pushed to the background as the drama over the prospective groom's earlier "marriage
" to a Hyderabadi girl took a Bollywood-style twist on Friday.

Ayesha alias Maha Siddiqui, who has been claiming that Shoaib had married her, produced a nikah-nama (marriage certificate) as proof of her wedding which was promptly dubbed by the Malik family as invalid.

Ayesha told TOI that all she wants now is an "official divorce". "I am not begging for sympathy," she claimed and added that they were well-off financially and therefore, not doing this for money.

In response, the Maliks are now threatening to expose Ayesha. Shoaib's brother-in law Imran Zafar, who was shopping in Lahore on Friday for the wedding slated to take place in Hyderabad on April 15, said the Malik family is unfazed by Ayesha's claims.

"Shoaib was duped and shown pictures of another girl as Ayesha. We have pictures of the girl who posed as Ayesha which were sent from Ayesha's email ID," he said.

Imran said Shoaib had fallen madly in love with a girl whose pictures were sent to him. "But that girl wasn't Ayesha. Shoaib was trapped. Ayesha would tutor him online and have him parrot the line at some select interviews that they were married," the brother-in-law said.

However, Ayesha retorted by saying: "I don't think Shoaib is a small kid. He's 30 years old and led an international cricket team."

The nikah-nama showed the ceremony as having taken place in Sailkot, Pakistan - Shoaib's hometown - on June 3, 2002. Apart from having the names of two local witnesses, it has Maha Siddiqui signing as the bride and an illegible signature that is purported to be that of Shoaib.

Ayesha claimed Shoaib had dumped her because he had by then become famous and was getting attention from women. Without naming anyone, Ayesha said one of Shoaib's teammates told him, "Bhabi is fat".

"He came back and yelled and screamed on the phone and said `I don't want to hear all this. It's embarrassing me'," Ayesha said.

She said she hoped that once she started losing weight, she could start living with him. "But little did I know that it wasn't me, it was all the attention he started getting, all of a sudden so many girls began to be interested in him," she said.

Ayesha added that Shoaib had barred her from meeting his cricket team members so that they will not know how she looks. But she claimed that Pakistani cricketer Mohammad Yousuf's wife knew about their marriage.

The Maliks maintain that Ayesha's claim that the duo met in Dubai and got married in 2002 was nothing but lies. In reply, Ayesha said: "The only thing I want now is an official divorce from him, but it has to be in the open and not behind closed doors because he can always deny it later."

According to the versions doing the rounds here, Shoaib had encountered two girls, Maha and one Ayesha, in the Gulf about a decade ago. "While Maha was fat, Ayesha was slim and good looking. The two girls chatted with the cricketer and left after they exchanged contact numbers and email addresses. From this point, Maha started calling up Shoaib and told him she was Ayesha. Shoaib began cosying up to her under the impression that he was interacting with Ayesha. The nikah over telephone too was performed in these circumstances," a source said.

According to the reports, Shoaib was under this mistaken impression when he visited Hyderabad in 2005 to play a match. While being interviewed by former cricketer Arun Lal at the presentation ceremony, Shoaib had apparently said Hyderabad was the hometown of his wife Ayesha. "It was only later that Shoaib realized that the girl whose photos he saw and the girl he was speaking to were not the same," the sources said.

However, if these reports are true, what happened to the real Ayesha and why is she not coming forward to clear the claims and counter-claims is still a mystery.

Both families are now threatening to up the ante. While the Maliks said they will release the photos of the real Ayesha, the Siddiqui family said they will release to the media soon a nikah-nama video that will prove her claim.

Meanwhile, the Sania Mirza family has begun distributing wedding cards for the ceremony slated to take place in a
five-star hotel on April 15. The Shoaib family is due to arrive in Hyderabad on April 6. Several top sports personalities and stars from Bollywood are expected to grace the occasion.

Asked about the name controversy, Ayesha said: "My name is Maha Siddiqui. Ayesha is the name given to me by my grandmother. Maha is the name in my passport. So ironically, when he says the wrong name was given during the nikah, well, both names belong to the same person, me."

Malik's residential address in the nikah-nama is given as A-4, Tariq Colony in Sialkot, which is the cricketer's hometown. The marriage was arranged by Zulfiqar Malik, the resident of the Sialkot Cricket Association and the two witnesses named in the contract are Mukhtar Ali Khan and Syed Mubashar Ali of Sialkot.

The contract states that the nikah was performed by a cleric named Hafiz Mohamamd Khalid and the `mehar' was fixed at Rs 500.

The document also bears the stamp of Nasir Khan, the local registrar of marriages. Imran Zafar, Shoaib's brother-in-law, however, dismissed the marriage certificate as invalid and said when no nikah ceremony ever took place the document had no value at all.

Meanwhile, a Pakistani television channel beamed excerpts of a 2004 interview in which Shoaib admitted he was married to Ayesha. Asked by the interviewer if girls had started approaching him as he was a young and successful cricketer, Malik had replied, "It seems you want me to be beaten by my wife. I am already married. My nikah has been done. She stays in Jeddah though she hails from Hyderabad in India. Her name is Ayesha and I am very happy."

It seems Bollywood is already drawing plans to make a film on this

Sonam to play Sania Mirza in Anees Bazmee’s next

ilmmaker Anees Bazmee has found an apt subject in Sania Mirza for his next film Thank You and who better to play the young tennis star than Sonam Kapoor.

As ace tennis sensation Sania Mirza gets ready to tie the knot with Pak cricketer Shoaib Malik, Anees Bazmee has planned to make a film on the sports icon. At the moment the tennis star's relationship is under media scrutiny.

According to a website, the film based on Sania will go on floors in mid-April. Reportedly the film will be shot in Canada and the film will be sans any sensationalism as it is set to be a romantic comedy.

Even though the director is denying that Sania is the subject of his film, the buzz is strong about the similarities between Sonam's role and Mirza's life.

The news portal quoted a source: "Just like Sania, Sonam plays a young, attractive tennis champ and falls in love with a guy, who is completely wrong for her. She soon realises her mistake and turns back before it's too late. Remember Sania calling off her engagement to Sohrab Mirza earlier this year before news of her impending marriage to Pakistani cricketer Shoaib Malik?"
